Decoding "Sufficient AI Literacy": A Phrase-by-Phrase Analysis of Article 4

Article 4 appears straightforward. It is not. Each phrase in this single-sentence provision creates distinct obligations that legal professionals must understand before they can claim compliance.


At first reading, Article 4 of the EU AI Act looks like a simple mandate: ensure your people have AI literacy. Many organisations have treated it that way -- purchasing generic awareness training, ticking the box, moving on.

That approach misreads the provision. Each of its carefully chosen phrases creates specific obligations that generic programmes fail to satisfy. Let us take it apart.

Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used.

One sentence. Seven distinct regulatory elements. Each one matters.

"Shall Take Measures"

The provision uses "shall" -- the strongest form of obligation in EU legislative drafting. There is no opt-out, no materiality threshold, no exemption.

The word "measures" is equally important. The obligation is to take affirmative steps -- an obligation of means, not results, but one requiring demonstrable action. An organisation that has taken no measures cannot satisfy Article 4, regardless of how literate its staff may happen to be through independent effort.

"To Their Best Extent"

This is the provision's proportionality mechanism. The obligation is calibrated to what an organisation can reasonably achieve given its resources, scale, and context.

A solo practitioner's reasonable effort might be self-directed study and a verification protocol. A multinational firm's effort requires formal training, competency assessments, role-specific curricula, and ongoing monitoring. What "best extent" does not mean is minimal effort. Regulators will assess whether measures were proportionate to the organisation's capacity and its AI deployment risks.

"A Sufficient Level"

This is the provision's most consequential phrase -- and its most deliberately ambiguous one. The regulation avoids prescribing specific training hours, curricula, or certification standards. "Sufficient" is inherently contextual.

For lawyers, sufficiency means literacy adequate to use AI tools competently within the relevant practice area, identify when outputs require verification, recognise ethics implications, understand disclosure obligations, and assess risks to confidentiality and competence.

Sufficiency does not mean comprehensive technical knowledge. A corporate lawyer does not need to understand transformer architectures -- but does need to understand why a contract review AI might miss non-standard clauses and when AI analysis requires human verification. The standard will sharpen over time through guidance, enforcement, and professional body interpretations.

"Of Their Staff and Other Persons"

The literacy obligation extends beyond employees. "Other persons dealing with the operation and use of AI systems on their behalf" captures contractors, consultants, secondees, and anyone interacting with AI systems under the organisation's authority.

If contract lawyers use AI tools on the firm's matters, the firm bears the Article 4 obligation for their literacy. If work is outsourced to a provider using AI, the firm must consider whether that provider's staff meet the standard.

"Taking into Account Technical Knowledge, Experience, Education and Training"

AI literacy requirements must be tailored to the individual's existing foundation. The regulation explicitly rejects a one-size-fits-all approach.

Training must build on legal expertise, not assume technical backgrounds. A senior partner with thirty years of experience requires a different pathway than a junior associate who studied computational law. Organisations must assess existing competence before designing training and build differentiated programmes for different roles.

"The Context the AI Systems Are to Be Used In"

Context-sensitivity is Article 4's organising principle. The literacy required for legal research differs from that required for contract review, litigation prediction, or compliance analysis. Jurisdictional context matters too: a lawyer in Italy, where Law 132/2025 imposes specific disclosure requirements, needs literacy encompassing those local rules.

For compliance programmes, training must be mapped to actual deployment contexts -- not delivered as a generic overview.

"Considering the Persons or Groups of Persons on Whom the AI Systems Are to Be Used"

This final phrase reflects the AI Act's human rights orientation. AI systems affecting vulnerable populations or high-stakes decisions require higher literacy from operators.

A lawyer using AI to analyse discrimination claims needs literacy about algorithmic bias. A lawyer using AI in criminal defence needs literacy about due process implications. The same tool, used in the same firm, may require different literacy levels depending on the matter and the people affected.

The Compound Effect

These seven elements create an obligation far more sophisticated than "train your staff on AI." Article 4 requires affirmative, proportionate, role-appropriate, context-specific, and impact-aware measures -- maintained on an ongoing basis as tools and risks evolve.

Generic off-the-shelf training may be a starting point. It is not a finishing point. Organisations that understand this will build programmes that genuinely improve how professionals work with AI. Those that do not will discover that a certificate of completion is not the same as compliance.
